These general terms and conditions of sale (hereinafter the "GTC") as well as the "Legal Notices" section are applicable to the merchant website www.grenadinehair.com (hereinafter "the Grenadine Hair® Online Store "), offering the sale of cosmetic products under the Grenadine Cosmetics® brand (hereinafter the "Products") intended for delivery in mainland France, Corsica, Monaco (excluding PO boxes) and Europe (hereinafter the "Territory"). Any order on the Grenadine Hair® Online Store constitutes full and complete acceptance of these GTC by the customer who makes a purchase there (hereinafter the "Customer"). PRICE AND PAYMENT
The price of the Products will be as quoted at any time on our website, except in cases of obvious error. Errors may occur despite our best efforts to ensure that the prices shown on the Website are accurate. If we detect an error in the price of the Product(s) you have ordered, we will inform you as soon as possible and offer you the option of confirming your order at the correct price or cancelling it. ORDERING PROCESS
The Customer is invited to select the chosen Products and add them to the shopping cart by clicking on the "Add to cart" button. At any time, the Customer may delete any Products on the shopping cart view page by going to the "Shopping Cart" icon available on all pages of the Grenadine Hair® Online Store at the top right.
The Customer is invited to view the summary of their order by clicking on the "View Cart" button. At this stage, they can check the details of their order, identify any errors made in data entry and correct them.

GRENADINE cannot be held responsible for the inaccuracy of the information provided by the Customer. Since the creation of a customer account is linked to the placing of an order, registration is reserved only for people with a delivery address in the Territory. The customer account will provide access to a personal space allowing, in particular, the tracking of orders and access to invoices.
To finalize his order, the Customer:
- Must confirm their delivery and billing address, or provide a new delivery address for the Territory and/or billing address.

- Once payment has been confirmed, the Customer receives, immediately and at the latest before delivery, an email confirming their order.
The Customer formally accepts the use of electronic mail for confirmation by GRENADINE Company of the contents of the order.
CANCELLATION OF ORDER
Once payment has been made, if the Customer has created a customer account, they can modify their order by clicking on the "Modify your order" button which appears in the "My orders" section of their personal space, only if the order is being prepared. If this feature does not appear in the "My orders" section, this means that the order has been shipped and it is no longer possible to modify or cancel it. However, with or without creating a customer account, the Customer still has the option of exercising their right of withdrawal, the terms of which are described in Article 5 below.
GRENADINE Company reserves the right to refuse to honor the order in the event of a dispute with the Customer, until the dispute is resolved.
In these cases, the Customer will be informed by email of the cancellation of his order and will be reimbursed for the sums he may have paid prior to the cancellation of his order by GRENADINE.
REFUSAL TO PROCESS AN ORDER
We reserve the right to withdraw any product from this website at any time and to replace or modify any content or information contained on it. Although we always make every effort to fulfill all orders as best we can, exceptional circumstances may arise, such as a manufacturing or stock problem or a payment incident, and force us to refuse to process an order after having sent you the Order Confirmation. We reserve this right at any time. In this case, if payment has already been made, we will refund all amounts paid, including delivery costs, as soon as possible, using the same payment method as you used for the transaction. In all cases, this refund will not incur any fees for you. We will not be liable to you or any third party for the withdrawal of any product from this website, the removal or modification of any material or content contained therein, or the failure to process an order in the circumstances referred to above, after sending the Dispatch Confirmation.
DELIVERY
Subject to the provisions of clause 7 above regarding product availability, and except in exceptional circumstances, we will endeavour to deliver the product(s) listed on the Dispatch Confirmation to you before the time indicated on the same Dispatch Confirmation or, if no date is indicated, within the indicative time given when choosing the delivery method, and, in any case, within a maximum of 30 days from the date of the Order Confirmation. Delays may nevertheless occur in the event of unforeseen circumstances or for reasons related to the delivery location. If we are unable to meet the delivery date for any reason, we will inform you and offer you either to continue the purchase process with a new delivery date or to cancel your order and refund you the full amount you have paid. Please note that no home deliveries are made on Saturdays, Sundays or public holidays. For the purposes of these Terms, "delivery" will be deemed to have been made, or the order will be deemed to have been "delivered", at the time when you or a third party designated by you are in physical possession of the products, which will be evidenced by the signing of the order acknowledgment at the delivery address you have provided to us.
IMPOSSIBILITY OF DELIVERY
If we are unable to deliver your order, we will endeavor to find a safe place to leave your parcel. If we cannot find a safe place, your order will be returned to our warehouse. We will also leave you a notice telling you where your order is and how to arrange redelivery. If you are not at the delivery location at the agreed time, please contact us to arrange delivery at a later date. If the order has still not been delivered, for reasons beyond our control, after 30 days from the date your order was available for delivery, we will consider that you wish to end the Contract and it will be terminated. As a result of the termination of the Contract, we will reimburse you for all amounts paid, including delivery costs (except for the additional costs related to the choice of a method of delivery other than the ordinary and least expensive method of delivery offered by us), as soon as possible and, in any case, within 14 days from the moment the Contract is considered to be terminated. Please note that we will be entitled to charge you for any additional transport costs inherent in the termination of the Contract.
PRODUCT PRE-ORDER:
Pre-ordered products placed on the website as a "Pre-order" may be subject to longer delivery times than other orders. These delivery times will be mentioned on the website, but the products will in any case be delivered within a maximum of 30 days from the date of the Order Confirmation. Orders containing both standard products and pre-ordered products ("Mixed Orders") may be delivered separately and at different times. As soon as the Pre-ordered products have been prepared, we will inform you of their dispatch by sending a Dispatch Confirmation. You have the right to withdraw from the contract within 14 days from the date on which you or a third party other than the carrier designated by you takes physical possession of the products without giving any reason. In the event of Mixed Orders, the withdrawal period expires after 14 days from the date on which you or a third party other than the carrier designated by you takes physical possession of the last product ordered. The foregoing provisions are without prejudice to the contractual right of withdrawal of 30 days from the date of the Dispatch Confirmation which you benefit from for each of the products which can be delivered separately in the event of Mixed Orders. If you make a purchase of a Pre-ordered product, all the provisions of these Conditions will also apply to you.
DELIVERY TERMS
GRENADINE Company delivers ordered Products only to Metropolitan France, Corsica and Monaco (excluding PO boxes). Delivery is guaranteed within a maximum of thirty (30) working days from receipt of the order confirmation email. Several delivery options are available:
DPD: Delivery to Pick Up relay.
The Customer is informed by email and SMS of the collection of the package by the DPD carrier as well as the precise delivery date. The Customer then has the option to modify the initially planned delivery, by changing the delivery address within the same department or by changing the delivery date on the DPD.fr website within ten (10) working days following the initially planned delivery date.
As soon as the package is delivered to the Pickup point, the customer receives an email and/or text message. The merchant will systematically check their ID upon collection, and the customer must sign on the PDA (a device used to scan packages).
Your package will remain available for 8 days at your Pickup relay point, from the delivery date.
DPD: Home delivery
Once your order is ready, DPD will send you a text message with several delivery date and time slot options. You can select the date and one-hour slot that best suits your needs by responding directly via text message (the same price as a standard text message) or by logging into the recipient area available on dpd.fr. On the day of delivery, you will receive a text message indicating a one-hour delivery slot.
In the event that delivery is not possible due to the Customer's absence at the delivery location, the Customer will be contacted by SMS and email to schedule a new delivery. Where possible, a delivery notice will also be left at the Customer's home.
Information regarding delivery terms is also accessible from the shopping cart validation page, as well as on the order summary page, before payment of the order.
No delivery will be made by GRENADINE Company if full payment of the price proves impossible.
Delivery costs
Delivery costs must be added to the total price of the order.
RETURN METHOD
To return one or more Product(s), the Customer must return, by Post, within this period of fourteen (14) calendar days from receipt of the Product(s) ordered, the Product(s) to GRENADINE Company, accompanied by the duly completed and signed return form available upon simple request by e-mail to contact@grenadinecosmetics.com
Each Product must be returned new with its original packaging. In the event of depreciation of the Product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product, GRENADINE Company reserves the right to refuse reimbursement or exchange of the Product. GRENADINE Company will not make any reimbursement if the Products returned by the Customer do not correspond to the Product(s) ordered or have an origin other than the Grenadine Hair® Online Store .
In the event of withdrawal, the shipping costs for returning the products to GRENADINE are the responsibility of the buyer. In the event of a partial return of the Products, the Delivery Costs will not be reimbursed by GRENADINE to the extent that the Customer has benefited from the delivery service for the retained Products.
RECEIPT OF PRODUCTS
Upon delivery of the order, the Customer must check the conformity and condition of his order in the presence of the carrier and, where applicable, make any necessary reservations regarding apparent defects (missing product, damaged package).
The Customer is invited to contact the Grenadine Hair® Online Store Customer Service within fourteen (14) working days of receiving the products. Unless there is a legitimate reason, any claim made after this period will be considered inadmissible.
THE RIGHT OF WITHDRAWAL
The Customer has the possibility, without reason, to withdraw from his order within a period of fourteen (14) calendar days from the day of receipt of the product(s) ordered, the date appearing on the carrier's receipt signed by the Customer being authentic. When this period of fourteen (14) days expires on a Saturday, Sunday or public holiday, it is extended until the first following working day. To exercise his right of withdrawal, the Customer can notify his decision to withdraw by returning the product directly accompanied by the pre-filled return slip/withdrawal form, duly completed and signed. This form is available upon simple request by email to contact@grenadinecosmetics.com
In any event, the Products must be returned within fourteen (14) calendar days from receipt of the Product(s) ordered, in accordance with the terms described below (point 5.2).
However, for health and hygiene reasons, GRENADINE cannot accept the return of all Products. Therefore, Products that are sealed cannot be subject to the right of withdrawal if they have been unsealed by the Customer.
REFUND OF THE ORDER
GRENADINE Company will refund the returned Products, as well as the Delivery Costs paid by the Customer by crediting the bank card used for payment in the event of a non-compliant or damaged product, error in the contents of the order, etc.
The refund will be made within a maximum period of fourteen (14) days following (i) the return of the Products or (ii) the date on which the Customer provided proof of shipment of the Products (the date retained being that of the first of these events).
RETURN OF DEFECTIVE PRODUCTS
If you believe that the product does not conform to the Contract at the time of delivery, you must contact us immediately using the form provided for this purpose, informing us of the characteristics of the product in question and the nature of the defect; you can also call us on 09 86 87 11 71 (Call not surcharged, excluding any possible costs depending on your network), we will then tell you what to do. We will examine the returned product in detail and inform you by email, within a reasonable time, whether the product can be exchanged or if you are entitled to a refund (if applicable). We will refund or exchange the product as soon as possible and, in any case, within 14 days from the date on which we have confirmed to you by email that you are entitled to a refund or exchange of the product in question. If a defect or damage is proven, the returned products will be subject to a full refund, including the delivery costs you have paid and the costs incurred for the return. The refund method will always be the same as the payment method for your purchases. All rights you have under applicable regulations are preserved in all cases.
APPLICABLE LAW / DISPUTES
These General Terms and Conditions are subject to French law, excluding its provisions which would refer to the application of a foreign law.
In the event of a dispute relating to the Grenadine Hair® Online Store , an amicable solution will be sought. Failing this, the French courts will have territorial jurisdiction to hear any dispute, with the exception of the provisions of the General Terms and Conditions which would refer to the jurisdiction of a foreign court.
WARRANTY DISCLAIMER
If the Products returned by the Customer do not correspond to the Products ordered and have an origin other than the Grenadine Hair® Online Store , the GRENADINE Company will not be bound by its obligations described in articles 8.1 and 8.2 above.
MEDIATION

NON-CONFORMITY AND HIDDEN DEFECTS
GRENADINE Company is bound by the legal guarantee of conformity and that relating to defects in the item sold (1). The Customer is invited to check the conformity of the Products received in execution of his order and, in the event of a defect found, to contact the Customer Service of the Grenadine Hair® online Store which will ensure its support by indicating the terms of return and replacement or reimbursement.
GRENADINE Company will replace or repair the returned Product after receipt and examination of the Product in question.
The Client:
- benefits from a period of two years from delivery of the goods to act;
- when repair is possible, may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code
- is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for used goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
(1) Article L211-4 of the Consumer Code: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility under the contract or has been carried out under his responsibility.
Article L211-5 of the Consumer Code: To comply with the contract, the goods must:
1. Be suitable for the use usually expected of a similar good and, where applicable: – correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model; – present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2º Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. Article L211-9 of the Consumer Code: In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods.
However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate compared to the other method, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer.
Article L211-12 of the Consumer Code: Action resulting from lack of conformity is prescribed after two years from delivery of the goods.
Article 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
Article 1644 of the Civil Code: In the case of Articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or of keeping the item and having part of the price refunded.
Article 1648 paragraph 1 of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.
